Cops: Quarrel over coffee maker triggered alleged cookie battery

NOVEMBER 22–A Florida pensioner threw a package of Oreos at his wife, causing the 75-year-old victim to fall to the ground, according to cops who arrested the man on a felony battery charge.
In a police interview, the woman said she and the accused, John Sandoval, 70, got into a “verbal argument in reference to the coffee 
maker not having any water in it.” The quarrel took place Saturday in the pair’s home in Sorrento, a town 30 miles north of Orlando.
The couple’s dispute turned violent, a probable cause affidavit states, when Sandoval “threw a package of Oreo cookies hitting her in the chest, causing her to fall.”
While she was on the ground, the victim said, Sandoval put his hands on her throat, “but did not restrict her airway.”
During police questioning, Sandoval said his wife was yelling at him “when he picked up a package of cookies and threw them at her,” adding that he thought the Oreos struck his spouse in the head.
The Oreos, not further described, were not confiscated as evidence.
Sandoval, who said he helped his wife up from the floor, claimed to have no recollection of grabbing her by the throat.
Pictured above, Sandoval was charged with battery on a person 65 or older, a felony. He was freed from the county jail Monday after posting $2000 bond. A judge has ordered him to have no contact with his spouse.
According to court records, Sandoval was convicted in 2005 on a misdemeanor battery count and sentenced to three years probation and ordered to complete a “domestic violence intervention class” and a “batterers intervention program.” The victim in the earlier prosecution is the same woman as in the pending case.
While a 2005 docket entry states that Sandoval “is a convicted felon,” details of that reported prior are unavailable. (2 pages)
