: Biden says he opposes expanding Supreme Court even after he criticizes affirmative-action ruling

President Joe Biden on Thursday indicated that he remains opposed to expanding the Supreme Court, even as he criticized the high court’s ruling against affirmative action at universities.

In an MSNBC interview, Biden was asked if he’s worried that without reforms for the Supreme Court, its conservative majority is “too young and too conservative” so it could do “too much harm.”

“Well, I think they may do too much harm, but I think if we start the process of trying to expand the court, we’re gonna politicize it, maybe forever, in a way that is not healthy,” the president said.

His remarks in the MSNBC interview came in the late afternoon, following a White House speech in which the president said he disagreed with the court’s decision on race-conscious college admissions.

“I think that some of the court are beginning to realize their legitimacy is being questioned in ways it hadn’t been questioned in the past,” Biden also said in the interview, adding that could include Chief Justice John Roberts.

In October 2020, Biden promised to establish a bipartisan commission to study reforms for the federal judiciary, including expanding the Supreme Court. The commission issued a report in December 2021, but didn’t give a recommendation on the issue of expanding the court.
