In a recent update, the Himachal Pradesh High Court has ordered a directive to the Deputy Commissioner of Kullu district, asking to establish an upper age limit for individuals participating in adventurous sports such as kayaking and river rafting in the region.

Furthermore, the bench comprising Justice MS Ramachandra Rao and Jyotsna Rewal Dua talked about the importance of requiring senior citizens engaging in such activities to present a “fitness certificate,” as reported by Live Law.
The court stated, “It is desirable to establish an upper age limit for individuals intending to participate in kayaking or related river sports, and also to mandate senior citizens participating in such activities to provide a Fitness Certificate.”

In November 2023, the High Court scrutinized the enforcement of safety regulations in river rafting and other adventurous sports. During this review, the court identified deficiencies in safety protocols and highlighted instances of non-compliance with Rule 11(b) of the Himachal Pradesh River Rafting Rules, 2005. This rule stipulates that operators of river rafting must possess two rescue rafts or a combination of one raft and a kayak.
Building upon previous rulings, the recent decision of the court aims to reinforce safety measures in river sports, particularly following the tragic death of a 65-year-old tourist.

The court has scheduled further deliberations on the matter for July 18.
