TheParliament Speaker of Parliament, Alban Bagbin has told the President of Ghana that his nominees for Ministers and Deputy will not be approved by Parliament until he signs the Anti- Gay Bill.
He said that the Supreme Court was now hearing a legal challenge, and he suspended the review of these nominations.
The MP Rockson-Nelson Etse K. Dafeamekpor of the South Dayi constituency sought an interlocutory injunction, which prompted the suspension. Parliament’s capacity to move on with the approval procedure for the President’s candidates has been essentially suspended by this injunction.
This decision also complies with a direction from the presidency, which stopped Parliament from moving the Bill on Human Sexual Rights and Family Values forward for signature by sending them a cease and desist letter.
The instruction issued by the presidency was justified by the ongoing legal processes at the Supreme Court.
Bagbin ruled that Parliament could not examine the President’s nominations in the context of these legal proceedings until the Supreme Court made a decision about the interlocutory injunction. He claimed that this choice is consistent with the dedication to protect the rule of law.
“The Parliament of Ghana will comply with the existing legal framework and reject the attempts by the Executive Secretary of the President, through his contemptuous letter, to instruct the Clerk to Parliament, an Officer of Parliament whose position is recognizably under the Constitution. We shall not cease and desist!
“Be that as it may, Hon Members, I also bring to your attention, the receipt of a process from the Courts titled Rockson-Nelson Etse K. Dafeamekpor vs. The Speaker of Parliament and the Attorney-General ( Suit no. J1/12/2024) which process was served on the 19th of March 2024 and an injunction motion on notice seeking to restrain the Speaker from proceeding with the vetting and approval of the names of the persons submitted by His Excellency the President until the provisions of the constitution are satisfied.
