Bombay High Court’s intervention sought over Economic Offences Wing report on scam

A complainant in the Maharashtra State Co-operative Bank scam case has sought the intervention of the Bombay High Court in the second closure report filed by the Economic Offences Wings (EOW) in January.

The second closure report is still under consideration by the special court which is yet to take a decision.

A complainant in the Maharashtra State Co-operative Bank scam case has sought the intervention of the Bombay High Court in the second closure report filed by the Economic Offences Wings (EOW) in January before a sessions court in Mumbai.

The Economic Offence Wing of Mumbai Police, which is investigating the alleged scam, had filed a closure report on the case earlier this year.

This is the second closure report that has been filed in the case, with each of the closure reports being filed when NCP leader Ajit Pawar was part of the government in the state.

The second closure report is still under consideration by the special court which is yet to take a decision.

Meanwhile, an affidavit has been filed by former MLA Manik Jadhav before the Bombay High Court, which elaborated that the second closure report specified that there is no criminal offence in the transactions allegedly linked to Deputy Chief Minister Ajit Pawar, his wife Sunetra Pawar and nephew Rohit Pawar, who is part of the Sharad Pawar-led faction of the NCP, and others.

Jadhav claimed the partisan and biased investigation conducted by EOW warranted a High Court monitored investigation.

The affidavit pointed out that the Enforcement Directorate (ED) had taken cognisance of the EOW FIR and unearthed several incriminating materials to establish the scheduled offence which was also shared with EOW.

The ED also filed prosecution complaints in the case in April and August 2023. Despite that, the EOW chose to file a closure report, the affidavit highlighted.

The affidavit was filed in a writ petition filed by the complainants, Surinder Arora and Jadhav, seeking transfer of the EOW investigation to the Central Bureau of Investigation (CBI) on the grounds of bias.

The petition was filed in 2021 after EOW filed its first closure report in the case.

Jadhav claimed in the affidavit of May 7 filed by advocates Satish Talekar and Madhvi Ayyappan that “it had become impossible that even the central agencies would act in a non-partisan manner and conduct an impartial investigation in the matter.” In view of this, High Court monitored special investigation team (SIT) was sought by Jadhav.

Arora, along with Jadhav, stated in the petition that EOW “played a fraud on the process of investigation and also the judicial process” by conducting an entirely biased investigation only to protect the accused persons rather than conducting fair, transparent and impartial investigation.
