Drunk motorist who killed Brit in Spain cleared as ‘alcohol had no affect on his driving’

A motorist who was over the drink drive limit when he ran over and killed a Brit crossing a road on a Spanish island has been cleared of any wrongdoing.

Alan Taylor, 39, was on a pedestrian crossing near his home in Palma, Majorca, when he was hit by a car said to have run a red light in June 2020. He was rushed to hospital but died in hospital five days later.

When tested, the driver was found to be twice the legal limit. During a trial several witnesses corroborated the driver’s claims the light had been green. It was also reported during proceedings a rubbish truck had blocked the driver’s vision when the accident happened.

The driver, who has not been named, told the court in Palma he had not seen the victim crossing over, Majorca Daily Bulletin reported. He added: “I suddenly noticed a blow, I got out of the car and saw a person on the ground.”

The judge upheld an earlier hearing at a lower court last year absolving the driver of the Brit’s death. He was acquitted as the court ruled alcohol had not affected his driving on the night of the accident.

A witness had told the court: “The car crossed on green, but at high speed. It was clear from afar that what happened was going to happen. I myself shouted “he’s going to run over him.”

An autopsy found Mr Taylor had consumed alcohol and benzodiazepines – usually prescribed for anxiety or depression – and he had impaired reflexes. Prosecutors had called for the driver to be sentenced for two and a half years and have his driving licence withdrawn.
