European Union Cancels Tender After Kenyans Quote Above Market Prices

The European Union, through the 11th European Development Fund (EDF) on Tuesday, announced that it was cancelling a Kenyan tender after bidders quoted above market prices. 

Interested bidders had been asked to submit their tender documents for the construction of underground, high and low-level water tanks, septic tank, sewer system, public toilets, cold room, hazardous room and transhipment shed at Moyale Border Post in Kenya. 

The project was expected to be financed by EDF in partnership with the Common Market for Eastern and Southern Africa (COMESA) under the supervision of the Ministry of Investment Trade and Industry.  

Speaking on the cancellation of the tender, it was revealed that EDF did not see value for money in investing in the program.

During the floating of the tender, it was reported that bidders would be subjected to Local Competitive Procurement using a Request for Bids (RFB) formulae as specified in the EDF and COMESA guidelines.

The tender was divided into four lots with the first lot dealing with the design and construction of underground, high- and low-level water tanks and a pump house at Moyale Border Post. 

Lot 2 was the design and construction of toilets and rehabilitation of the sewer system at Moyale Border Post with the third lot being the design and construction of the cold room and hazardous goods room. 

Lastly, the last part of the tender was the Design and Construction of a Transhipment Shed. 

EU has now cancelled the first lot and made changes to the other lots after exaggeration of offer prices. 

“The lot is not awarded because there were no financial worthwhile tenders as the prices offered were significantly above the market prices and did not represent value for money,” EU stated. 

“Should a new tender procedure be launched for this project, a new contract notice will be published, unless the contracting authority awards the contract through a negotiated procedure in which case only the award of the contract will be published.”

Lot 2 was amended by cancelling the design and construction of the cold room but maintained the design and construction of the hazardous goods room.
