Justice Obiora Egwuatu of the Federal High Court, Abuja has declared unconstitutional, null and void Sections 6, 7, 8, 9, 11 and 30 of the Money Laundering (Prevention and Prohibition) Act 2022 in so far as they relate to legal Practitioners.
A Private Legal Practitioner, Abu Arome filed the suit in FHC/CS/25/23 against the Central Bank of Nigeria, Economic and Financial Crimes Commission, Attorney General of the Federation and Guarantee Trust Banks as Defendants, seeking to bar the Defendants from enforcing the provisions of the Money Laundering Act 2022 against Legal Practitioners.
The Court granted the reliefs sought by the Plaintiff.
The Court also held that the restrictions placed on bank accounts operated by the Plaintiff’s law firm with account numbers 0725501429(Naira) 0725501443(Pounds) 0725501436 (Dollar) 0725501450 (Euro) on the basis of the circular of the 1st Defendant is unconstitutional, null and void.
