On January 1, 2021, Malaysia and Singapore had jointly declared the termination of the 350km HSR project after the two countries had been unable to reach an agreement on changes proposed by Malaysia before the project agreement’s expiration on December 31, 2020. – The Malaysian Insight file pic, January 18, 2024.

A MAN has submitted an appeal to the Court of Appeal, seeking the reinstatement of a lawsuit filed against the government and four others concerning the cancellation of the Kuala Lumpur-Singapore High-Speed Rail (HSR) project.

Lawyer Mohaji Selamat, representing Mohd Hatta Sanuri, said that the notice of appeal was filed on January 12 this year. Hatta initiated the lawsuit on his behalf and on behalf of more than 32 million Malaysians allegedly affected by the project’s cancellation, filing the suit two years ago on December 30, 2022.

In addition to the government, Hatta has listed former prime ministers Dr Mahathir Mohamad and Muhyiddin Yassin as defendants, along with former minister in the Prime Minister’s Department (Economy) Mustapa Mohamed and former transport minister Wee Ka Siong.

In his statement of claim, Hatta sought a court order to declare the cancellation of the HSR project null and void. He also requested that all defendants pay RM1 million in compensation to him and all Malaysians for wrongfully and negligently canceling the project.

Nevertheless, the High Court in Kuala Lumpur dismissed the lawsuit on December 15, 2023. Judicial Commissioner Roz Mawar Rozain ruled that Hatta had no locus standi to initiate the suit and deemed it an abuse of the court process.

She also ordered Hatta to pay costs of RM10,000.

On January 1, 2021, Malaysia and Singapore jointly declared the termination of the 350km HSR project. The decision came as the two countries were unable to reach an agreement on changes proposed by Malaysia before the project agreement’s expiration on December 31, 2020.

In accordance with this termination, Malaysia compensated Singapore with US$102.8 million (RM361.7 million) to cover costs incurred for the development of the HSR project and associated expenses related to the extension of its suspension.

The project was expected to provide three main services, which were direct travel between Malaysia and Singapore within 90 minutes, domestic service in Malaysia and shuttle service from Iskandar Puteri (Johor) to Singapore. – Bernama, January 19, 2024.
