News Investigators/ The Supreme Court Thursday dismissed the appeal of Tonye Cole and the All Progressives Congress (APC) against the election of Siminalayi Fubara as Rivers State governor for lacking in merit.
Similarly, the Supreme Court affirmed the election of Agbu Kefas as Taraba governor.
Delivering judgment, Justice Lawal Garba dismissed the appeal by the New Nigeria Peoples Party (NNPP) and its governorship candidate, Yahaya Sani for filing incomplete record of appeal.
The apex court also dismissed the appeal against Mr. Fubara as incompetent.
According to the court, the appellant did not prove the allegations of noncompliance with the Electoral Act, among other claims.
Mr. Cole had challenged Mr. Fubara’s victory alleging irregularities, noncompliance with the Electoral Act, and corrupt practices, among others.
Mr. Cole, who was the APC candidate in the March 18, 2023 election, was challenging the victory of Mr. Fubara on the ground that he did not resign as the accountant general of Rivers State before the election.
He sought the reversal of the judgements of the Court of Appeal and the Tribunal, which upheld the declaration of Fubara of the Peoples Democratic Party (PDP) as the winner of the Rivers Governorship Election.
