Union mantri gets interim protection against arrest

on Friday granted interim protection from arrest to Union minister of state

Nisith Pramanik

in an attempt to murder case against him and directed

West Bengal government

not to take any coercive action against him.
A bench of Justices Bela M Trivedi and Pankaj Mithal granted the protection after Pramanik’s lawyer and senior advocate P S Patwalia submitted that situation in West Bengal is volatile and he could be arrested despite his pre-arrest bail plea scheduled for hearing in HC on January 22.

Senior advocate Gopal Sankaranarayanan, appearing for West Bengal government submitted that the petitioner should have approached the Chief Justice of the HC high court for early hearing on his pleain high court.
Though he assured the court that no arrest would be made, Patwalia, however, pressed the bench to pass an interim order for protection.

The bench thereafter passed a brief order and said “Senior counsel for the petitioner states that the next date when the circuit bench at Jalpaiguri is likely to sit is January 22.
Senior counsel for the State of West Bengal has no objection if the matter is heard on the date fixed. In view of the above, let the application be listed before the circuit bench, if not listed on January 22. We request that it is heard and disposed of as expeditiously as possible on the same day. No coercive step shall be taken against the petitioner till the matter is heard by the high court,” the bench said.

West Bengal police registered a criminal case against Pramanik for offences under the Arms Act and for attempt to murder. Pramanik then filed a plea for anticipatory bail before the Calcutta High Court, which on January 4 adjourned the matter.
