Apple Allegedly Filed Application to Declare Huawei’s “Vision Pro” Trademark Invalid

It is recently reported that the status of Huawei’s “Vision Pro” trademark is currently under review for “revocation/invalidation”, and the likely applicant is Apple. Public information shows that Huawei Technologies Co., Ltd. applied for this trademark on May 16, 2019, and officially registered it on November 28, 2021, with the exclusive rights expiring on November 27, 2031.

According to supply chain news, Apple’s Vision Pro will be launched in China as early as April and no later than May. Currently, Apple is preparing for the Vision Pro to enter the Chinese market, and one of the issues to be resolved is trademark rights.

According to lawyers, the trademark invalidation review process generally takes one to one and a half years, and after the results are out, an administrative lawsuit can be filed, and the first and second trials will take another year. This is obviously a pressing issue for Apple. After using the “Apple Vision Pro” trademark, there is still a risk of similar trademark infringement.

In the eyes of professionals, “distinctiveness” is the association between the trademark name and the goods using the trademark. The stronger the association, the weaker the distinctiveness, and vice versa. The word “Vision”, when used as a trademark for display devices including mixed reality headsets, has slightly weak distinctiveness.

Therefore, the legal departments of Apple and Huawei may face a showdown in the near future.
